The point was, you cant say one is not punishable because its a private joke, and the other is in the public interest because of the content it contained.
you have to back one argument.... either communications are taken at face value, even if private, and are punishable, or that they are to be considered private and therefore not punishable.
Your opinion is twisted to cover not the issue at hand, but the people involved.

I live right near the Hants/Surrey border, so i always view them as our main rivals.

I think its due to the contract clause, I believe neither side are meant to speak publicly until October, this is probably to stop KP suing the ECB.
