Downton transgressed on the confidentiality agreement between ECB and Pietersen and had to apologise. Given that he was almost certainly heavily involved in drawing up this agreement it would appear that he was as successful in his law training as he is in his ECB role.
If Pietersen has cancelled his lucrative IPL contract to play County cricket he must surely have had some assurances from ECB about consideration for England selection yet here is Whitaker contradicting this. This could get very messy and the lawyers getting involved.

Whitaker/Downton/Moores. even Emperor Clarke keep saying, when faced with the KP question, that they've found some new, young players they are pretty excited about, indeed, that they want the England supporters to get behind. And now they have recalled Trott.
