"Calling West Indies' pull-out midway into the India tour a "monumental disaster", the BCCI has slapped a US$41.97m damages claim on the WICB. The BCCI also suspended bilateral relations with the WICB till the dispute was resolved, and threatened legal action if the West Indies board didn't respond within 15 days."

I don't really see how the BCCI can press for damages when the WICB offered a replacement team to allow the series to continue.

That was my first thought when I heard of their intent to sue.

Surely the contract entered into only calls for West Indies to send a team of their own selection to contest the matches ? No clause that says "Team mustinclude Chanderpaul and Bravo " etc...

Seems a logical defence.

It will be interesting to see how this case progresses...well at least the team looks to be back to full strength for South Africa:

"Tensions between the WICB and the West Indies players have eased, and a way forward found, following meetings over the weekend, Caribbean newspapers have reported. That could mean West Indies' scheduled tour to South Africa in December will go ahead without hiccups. According to the reports, the WICB and the West Indies Players' Association (WIPA) will now renegotiate the players' contracts, with the players now having a say in payment matters, and WIPA and its chief Wavell Hinds will continue to represent the players' interests. Also, it was reported, a three-man task force has been created to deal with the BCCI's demands off the WICB. The committee reportedly comprises former West Indies cricketer and Barbados politician Wes Hall, Barbados chief justice and former prime minister David Simmons, and lawyer and Trinidad & Tobago politician Kenneth Lalla, and will go to work immediately given the BCCI's 15-day deadline for the WICB to respond to its claim of US$41.97m."

Would the BCCI have had insurance if the series could not have been finished?

Most major sporting events have insurance to cover an event incase a game or series could not be finished.

for me this seems ridiclous....how can BCCI sue... the windies offered to send a replacment side...and India declined....there's nothing in a series agreement that says that both teams have to be at full strength, so IMO BCCI don't have a leg to stand on..

WICB back-tracking now by saying nothing definite has been decided about the captaincy issue.

Haven't seen a soap opera this bad since Crossroads.

The WICB should countersue the BCCI for postponing the future tours.
